The 2007 Wizardry Constitution
of the
Ministry of Magic
PREAMBLE
We, the sovereign witches and wizards, imploring the aid of Merlin the Great, in order to build a just and humane Ministry and establish a Government that shall embody our ideals and aspirations to promote the common good, conserve and develop our patrimony, and secure to ourselves and our posterity, the blessings of democracy under the rule of law and a regime of fidelity, bravery, and integrity, do ordain and promulgate this Constitution.
ARTICLE I
COMMUNAL TERRITORY
The communal territory comprises of the wizarding places such as magical houses, schools, streets, towns, and muggle-related places consisting of its terrestrial, fluvial and aerial domains.
ARTICLE II
BILL OF RIGHTS
Section 1. No person shall be deprived of life, liberty, or property without due process of the Ministry of Magic, nor shall any person be denied the equal protection of the laws.
Sec. 2. The right of the people to be secure in their persons, houses, papers, wands and brooms against unreasonable searches and seizures.
Sec. 3. (1) Privacy of parcel and parchment shall be inviolable except upon lawful order of the Ministry of Magic or when public safety is concerned.
(2) Any evidence obtained in violation of this or the preceding section shall be directly imprisoned in Azkaban.
Sec. 4. The liberty of abode and of changing the same within the limits prescribed by the Ministry and of the Minister. Neither is the right to travel being except in the risk of magical security. Thus, any transportation magically in the land of the muggles shall be punished accordingly.
Sec. 5. The right of people to information on matters in public concern shall be recognized. Thus, subject to such limitations provided by the Ministry.
Sec. 6. The right of people such as magical employees and students to form societies, union and association.
Sec. 7. Private property shall not be taken unless it is asked for by the high court of the Ministry.
Sec. 8. (1) Any person under investigation for the commission of an offense shall have the right to be informed of his right to remain silent.
(2) The use of the three forbidden curse namely Avada Kedavra, Crucio and Imperio to threat or vitiate the free will is prohibited.
(3) Any confession or admission obtained in violation of the Ministry’s letter shall be lightly sentenced.
(4) Any victim of torture or trauma will have rehabilitation in accordance with the Ministry’s law.
Sec. 9. The right of the muggles, including the muggles in the main and other branches, to comply branchial laws for purposes not abridging the constitutional law.
Sec. 10. Private property of any member shall not be used by the Ministry without just compensation unless in judicial pressings of violation.
Sec. 11. In accordance with Sec. 9, Article III, no law shall inhibit unlawful or ultimately forced contract signing or any obligation of contract.
Sec. 12. Free access to Wizengamot proceedings shall not be denied by reasons of muggle degree.
Sec. 13. (1) No member shall be held to answer for an offense without due process of the law.
(2) The accused shall the right to give personal views.
(3) Any eyewitness shall be studied upon his background. Any advertence or anomaly shall be mark as unacceptable.
Sec. 14. No member shall be compelled to bear witness against himself/herself.
Sec. 15. No member shall be punished by political belief.
Sec. 16. Excessive fines shall not be imposed unless approved by the Commission on Higher Disciplinary Action.
Sec. 17. If the person is put twice in jeopardy of punishment or hearing by the same act of violence shall not be given an intense or more intense punishment from the first act.
Sec. 18. The Ministry will hereby give just proceedings no matter the position and or degree the accused or opposition is handling.
Sec. 19. The members of lower position shall be given the right to impeach the members thus higher than them with the due process of the law.
Sec. 20. Non-verbal actions within the proceedings are illegal.
Sec. 21. The branches shall be given the right as the jury to the Wizengamot proceedings.
ARTICLE III
MEMBERSHIP
Section 1. The following are the members of the Ministry of Magic:
(1) Those who are recruited by the 7 pillars of the Ministry.
(2) Those not younger of 13 years of age.
(3) Those of who had read at least 1 book and 2 movies of Harry Potter.
(4) Those who have passed the application exam.
Sec. 2. The members are those who are fit enough to be given the privilege of membership without having to perform any act to acquire or perfect their Ministry membership. Those who elect Ministry membership in accordance with paragraph (3), Section 1 of Article II hereof shall be deemed natural-born citizens.
Sec. 3. Ministry of Magic member may be reacquired or forfeit their membership.
Sec. 4. Ministry of Magic who befriends alien shall retain their membership, unless by their act or omission they are deemed under the law, to have renounced or forfeit it.
Sec. 5. Dual allegiance of membership is inimical to the Ministerial interest and shall be dealt with by law.
ARTICLE IV
LEGISLATIVE DEPARTMENT
Section 1. (1) The legislative power shall be vested by the Heads of the Department of Magical Law Enforcement, Department of Magical Accidents and Catastrophes, Department for the Regulation and Control of Magical Creatures, Department of International Magical Cooperation, Department of Magical Transportation, Department of Magical Games and Sports and the Department of Mysteries.
(2) The Department of Magical Law Enforcement shall be the most important of the various departments, and is a combination of police and justice facilities. The department head will be appointed by the Minister with the express consent of the Commission on Appointments. Its office shall be located on the second level of the Ministry of Magic, it incorporates:
o Auror Headquarters
o Improper Use of Magic Office
o Misuse of Muggle Artifacts Office
o Detection and Confiscation of Counterfeit Defensive Spells and Protective Objects Office
o Wizengamot Administration Office
(3) The Department of Magical Accidents and Catastrophes shall be responsible for repairing accidental magical damage. The department head will be appointed by the Minister with the express consent of the Commission on Appointments. Its office shall be located on the third level of the Ministry of Magic, it incorporates:
o Accidental Magic Reversal Squad
o Obliviator Headquarters
o Muggle-Worthy excuse Committee
(4) The Department of Magical Games and Sports shall deal with such sports-related pastimes as organizing the Quidditch World Cup and the Triwizard Tournament. The department head will be appointed by the Minister with the express consent of the Commission on Appointments. Its office shall be located on the seventh level of the Ministry of Magic, it incorporates:
o British and Irish Quidditch League Headquarters
o Official Gobstones Club
o Ludicrous Patents office
(5) The Department of Magical Transportation shall be responsible for various aspects of magical transport. The department head will be appointed by the Minister with the express consent of the Commission on Appointments. Its office shall be located on the sixth level of the Ministry of Magic, it incorporates:
o Floo Network Authority
o Broom Regulatory Control
o Portkey Office
o
(6) The Department for the Regulation and Control of Magical Creatures shall be responsible of the capture, disposal, relocation, registration, research of magical creatures. The department head will be appointed by the Minister with the express consent of the Commission on Appointments. Its office shall be located on the fourth level of the Ministry of Magic, it incorporates:
o Beast Division
- Centaur Liaison Office
- Committee for the Disposal of Dangerous Creatures
- Dragon Research and Restraint Bureau
- Werewolf Registry
- Werewolf Capture Unit
o Being Division
- Office of the House-elf Relocation
- Werewolf Support Services
- Goblin Liaison Office
o Spirit Division
- Ghoul Task Force

(7) The Department of International Magical Cooperation shall get wizards from different countries to cooperate and shall regulate international magical law. The department head will be appointed by the Minister with the express consent of the Commission on Appointments. Its office shall be located on the fifth level of the Ministry of Magic, it incorporates:
o International Magical Trading Standards Body
o International Magical Office of Law
o International Confederation of Wizards, British Seats

The Department of Mysteries shall deal studying with enigmas. The department head will be appointed by the Minister with the express consent of the Commission on Appointments. Its office shall be located on the ninth level of the Ministry of Magic, it incorporates:
o Thought Chamber
o Space Chamber
o Death Chamber
o Time Chamber
o Brain Room
o Hall of Prophecies
Sec. 2. The legislative department shall be composed of seven different heads.
Sec. 3. No person shall be member of the legislative department unless he/she is a wizard or witch, is at least fourteen years of age, and has a grade not lower than ACCEPTABLE (A) in any standard wizarding school.
Sec. 4. The term of office of the legislators shall be ten years, unless otherwise provided by law, at midnight on the thirtieth of July next following their appointment.
Sec. 5. The nomination and appointment of the legislators shall be seventy-two hours before midnight on thirtieth of the month.
Sec. 6. In case of vacancy, the Minister of Magic shall nominate and appoint a wizard or witch with the express consent of the Commission on Appointments, but the legislator appointed shall serve only for the unexpired term.
Sec. 7. The salaries of the legislators shall be 90 sickles.
Sec. 8. A legislator shall, in all offenses punishable not more than twenty years imprisonment in Azkaban.
Sec. 9. The legislators or any of its respective committees may conduct inquiries in aid of legislation in accordance with its duly published rules of procedure. The rights of persons appearing in, or affected by, such inquiries shall be respected.
Sec. 10. (1) The legislative, by a vote of five of the body, voting separately, shall have the sole power to declare martial law.
(2) In times of martial law or other communal emergency, the legislative department may, by law, authorize the Minister, for a limited period and subject to such restrictions as it may prescribe, to exercise powers necessary and proper to carry out a declared communal policy. Unless sooner withdrawn by resolution of the department, such powers shall cease upon the next adjournment thereof.
Sec. 11. (1) Every bill passed by the legislators shall embrace only one subject which shall be expressed in the title thereof.
(2) No bill passed by the legislators shall become a law unless approved by the Minister of Magic.
Sec. 12. The department head shall also be the head of offices it incorporates.
ARTICLE V
EXECUTIVE DEPARTMENT
Section 1. The executive power shall be vested in the Minister of Magic.
Sec. 2. No person may be appointed as Minister unless he/she is a wizard or witch, at least fourteen years of age on the day of appointment, has a grade not lower than ACCEPTABLE (A) in any wizarding school, and a resident of a magical community for at least ten years immediately preceding such appointment.
Sec. 3. There shall be a Chief Warlock of the Wizengamot and Supreme Mugwump of the International Confederation of Wizards which is to be posted by the Minister of Magic.
Sec. 4. There shall be a Senior Undersecretary, Junior Assistant and an Advisor who shall have the same qualifications and term of office and be appointed by the Minister of Magic with the express consent of the Commission on Appointments. He/she may be removed from office in the same manner as the Minister.
Sec. 5. The Minister shall be appointed by direct vote of the seven department heads for a term of fifty years which shall begin at noon on the seventh day of July next following the day of appointment and shall end at noon of the same date fifty years thereafter. The Minister shall not be eligible for any re-appointment. No person who has succeeded as Minister and has served as such for more than fifteen years shall be qualified for appointment to the same office at any time.
Regular appointment for Minister of Magic shall be held on the first Monday of July.
The person having the highest number of votes shall be appointed, but in case two or more shall have an equal highest number of votes, one of them shall forthwith be chosen by the vote of a majority of all members of the legislative department.
The Wizengamot, sitting en banc, shall be the sole judge of all contests to appointments, and may promulgate its rules for the purpose.
Sec. 6. Before he/she enters on the execution of his/her office, the Minister appointed shall take the following oath or affirmation:
“I do solemnly swear that I will faithfully and conscientiously fulfill my duties as Minister of Magic of its magical community, preserve and defend its Constitution, execute its laws, do justice to every wizard and witch, and consecrate myself to the service of the Wizarding Community”
Sec. 7. The Minister appointed shall assume office at the beginning of his/her term.
If the Minister appointed fails to qualify, the Senior Undersecretary shall act as Minister until the Minister appointed shall have qualified.
If a Minister shall not have been chosen, the Senior Undersecretary shall act as Minister until a Minister shall have been chosen and qualified.
If at the beginning of the term of the Minister, the Minister appointed shall have died or shall have become permanently disabled, the Senior Undersecretary shall become Minister.
Where no Minister shall been chosen or shall have qualified, where he/she have died or become permanently disabled, the Senior Undersecretary or, in case of his/her inability, the Junior Assistant or the Advisor, shall act as Minister until a Minister shall have been chosen and qualified.
The Legislative Department shall, by law, provide for the manner in which one who is to act as Minister shall be selected until a Minister shall have qualified, in case of death, permanent disability, or inability of the officials mentioned in the next preceding paragraph.
